Gaming bill filed as Texas gears up for 2023 legislative session

The Texas legislature will consider a bill that would amend the state’s constitution to legalize casinos at a limited number of locations and set the stage to permit sports betting.

The proposed law – Senate Joint Resolution 17 – would devise the framework for a new body named the Texas Gaming Commission, which would supervise legalized gambling in Texas.

Casino gambling would be authorized at a “limited number of destination resorts and facilities” with the proceeds going towards tax relief and funding for education and public safety.

The amendment’s author is Houston-based state senator Carol Alvarado, a Democrat who initially pre-filed the bill on 14 November 2022.

Ohio fines BetMGM, Caesars, DraftKings $150k for ad violations

The Ohio Casino Control Commission (OCCC) announced it is seeking a $150,000 (£126,000/€143,000) fine each from BetMGM, Caesars and DraftKings for advertising violations.

According to the regulator, the three operators, or their affiliates, all ran sports betting ads on multiple platforms that were in violation of both Ohio law and administrative rules relating to advertising and promotions.

“The sports gaming industry has received multiple reminders of the rules and standards for advertising and promotions, yet continues to disregard Ohio law,” said OCCC executive director Matthew Schuler. “These repeated violations leave the Commission no choice but to pursue administrative action to bring operators into compliance. The Commission takes responsible gambling seriously – and expects the industry to value the same.”

Bill proposed in Connecticut to ban greyhound racing

A bill has been proposed in the Connecticut General Assembly that would ban both greyhound racing within the state, as well as stop operators simulcasting racing from out-of-state locations.

Proposed H.B. No. 5042 – put forward by two Republican and one Democratic legislators – currently has been referred to the committee of public safety and security.

The individuals who proposed the bill are Rep. Klarides-Ditria from the 105st district, Rep. D’Agostino from the 91st district and Sen. Somers from the 18th district.

Vermont report calls for legal betting, but no more than six licences

Vermont’s 2022 Sports Betting Committee has called for sports betting to be legalised in the state, but with limited licences issued by a request for proposals.

The committee report outlines what the implementation of sports betting could look like in Vermont, detailing reasons why sports betting could be beneficial for the state.

It contains six core recommendations, beginning with the implementation of a legalised, state-controlled sports betting market.

A state-controlled market would mean that the state of Vermont would control how many licences are given out. In the report, the Committee states that there should be “minimum of two but not more than six” operators permitted to offer sports betting in Vermont.

In terms of the bidding process for licences, the Committee recommends that it should “be structured to be similar to New Hampshire or New York,” two states notable for high tax rates.

Norway extends Norsk Rikstoto monopoly for 10 more years

The government of Norway has extended Norsk Rikstoto’s exclusive licence to offer bets on horse racing for another 10 years.

Norway remains one of the last European countries with a state gambling monopoly. Lottery Norsk Tipping is the only body permitted to offer online casino gaming, while Norsk Rikstoto has the exclusive rights to take bets on horse racing.

The government said that the monopoly system is necessary because the types of games offered by Norsk Tipping and Norsk Rikstoto “have high prizes, high turnover or a high risk of creating gambling problems”.

Norsk Rikstoto’s monopoly will now last at least 10 more years, as the government announced that its licence would be extended until at least the end of 2032.

Ontario orders halt to all UFC betting amid integrity concerns

The Alcohol and Gaming Commission of Ontario (AGCO) has ordered all operators in the province to stop taking bets on the Ultimate Fighting Championship (UFC) due to integrity concerns.

The Ontario regulator said that operators should stop offering any UFC betting with immediate effect.

Ontario – which launched its regulated betting and igaming market on 4 April of this year – has a number of rules intended to protect sporting integrity.

All events for which betting is permitted “must be effectively supervised by a sport governing body which must, at minimum, prescribe final rules and enforce codes of conduct that include prohibitions on betting by insiders”.

In addition, there must be “integrity safeguards in place which are sufficient to mitigate the risk of match-fixing, cheat-at-play, and other illicit activity that might influence the outcome of bet upon events”.

Kahnawake council launches legal challenge against Ontario igaming laws

The Mohawk Council of Kahnawàke (MCK) has launched a constitutional challenge against iGaming Ontario and the attorney-general of Ontario, arguing that the province’s regulation of gambling is unconstitutional.

The Council – which runs its own gambling licensing regime – said that the Ontario regime did not meet the requirements for gambling outlined in Canada’s constitution.

As a result, it has filed a motion in the Ontario Superior Court of Justice to challenge the legality of Ontario’s igaming framework, which it said was “illegal and unconstitutional”.

GB gross gambling yield recovers to almost £10bn in 2021-22

Great Britain’s gross gambling yield (GGY), excluding lotteries, increased 16.5% to £9.93bn ($12.0bn/€11.53bn)
from April 2021 to March 2022.

The figures were supplied through industry research from the Gambling Commission.

While this is a significant rise, the total is 0.8% below the 2019-20 numbers, which mostly occurred pre-pandemic. Despite the increase in the headline numbers since this, the Commission reports that the number of bettors in the sector have fallen.

“Since Covid-19 restrictions were lifted in 2021 and products and opportunities to gamble are available to consumers again, the overall percentage of the adult population who gamble remains lower than it was pre-Covid (28%),” said the Commission.

This can be explained by gaming spend increasing to a proportionally larger extent than the number of consumers. However, as the Commission outlines, there are strong signs of increased participation in gambling activities from younger demographics.

Peru igaming regulations ban free bets, mandate supplier registration

Peru will ban free bets and demos, as well as mandating registration for suppliers, as part of its effort to regulate online gambling.

The detail comes as part of Peru’s efforts to regulate online betting and igaming. The country’s Congress unanimously voted for a bill to regulate the sectors in July, which was then signed into law in August, coming into effect 60 days later.

The law names the Ministry of Foreign Trade and Tourism of Peru (Mincetur) as the country’s official gambling regulator.

As regulator, the body established a number of rules that will apply to operators in the market, including a ban on free bets and supplier registration requirements.

These rules are subject to a consultation, with stakeholders able to submit their opinions until 2 December.

As the US goes to the polls for the midterm elections, there are plenty of races that could affect the progress of sports betting regulation and gaming expansion. Paul Girvan picks out the states to watch.

The 2022 US midterm elections, while important in so many ways, contain few issues directly related to gambling regulation.

Rather, they represent an opportunity to extract a thorn that has irritated the body politic and coloured the consideration and adoption of more gaming legislation, whether it be sports betting legislation or casino regulation.

Only in two states does gaming appear directly, or indirectly, on the ballot: California and Georgia.
